MEAL ASSEMBLY NETWORK SWEEPSTAKESOFFICIAL RULES - NO PURCHASE NECESSARY
1) HOW TO ENTER: This sweepstakes begins at 12:01 a.m. Eastern Time ("ET") on July 1, 2008, and ends at 11:59 p.m. ET on June 30, 2009, ("Entry Period"). To enter this sweepstakes go to http://www.mealassembly.net, complete the online entry form, and click to submit the form during the Entry Period. Entrants must complete entire entry form, and the completed entry form must be received by Sponsor during the Entry Period, to be eligible.
2) CONDITIONS OF ENTRY: Only one entry may be submitted per person. All multiple entries submitted by a single entrant are void. Incomplete entries are void. Proof of e-mailing does not constitute proof of delivery. By entering, entrants accept and agree to these Official Rules including all eligibility requirements. All entries become the property of Meal Assembly Network LLC ("Sponsor"). Neither Sponsor, nor its affiliates, partners, subsidiaries, divisions, advertising and promotion agencies, and respective employees of each (collectively "Sponsor Parties"), assume any responsibility for late, lost, illegible, misdirected, or undelivered entries or requests.
3) PRIZES: The prize winner will receive a prize good at a meal assembly location of the winner’s choice. The prize will be a meal package with a retail value of up to $250. Determination of date, time, and location of the Grand Prize will be at the sole discretion of Sponsor. Winner assumes responsibility for all other charges including, but not limited to any permits, licenses, registrations, taxes, and insurance fees, if any. The odds of winning depend upon the number of eligible entries received. Any federal and state taxes and any duties on the prize are the sole responsibility of the winner. No substitution or transfer of the prize is permitted except at Sponsor's sole discretion. All prizes will be awarded.
4) DETERMINATION OF WINNER: The prize winner will be determined in a random drawing from among all eligible entries received during the Entry Period, to take place on or about July 15, 2009. Drawing will be conducted by an independent judging organization whose decisions are final on matters relating to this sweepstakes. Sponsor will notify winner by mail or telephone, beginning on or about July 31, 2009. To qualify for a prize, a selected entrant may be required to sign an Affidavit of Eligibility, Consent to Publicity, Liability Waiver, and federal and state tax release. Failure to comply with all instructions in the prize notification, or return of prize notification as non-deliverable, may result in disqualification of the entry and determination of an alternate winner. By entering this sweepstakes, the winner agrees to grant Sponsor Parties the right to print, publish, broadcast, and use universe-wide in any media now known or later developed at any time or times, the winner's name, portrait, picture, voice, likeness, and biographical information for any purpose, including without limitation, for advertising and promotional purposes without additional consideration, except where prohibited by law.
5) ELIGIBILITY: This sweepstakes is open only to legal residents of the United States, 18 years of age or older at time of entry, with pre-existing Internet access. Residents of Puerto Rico and residents of states where this sweepstakes is prohibited are not eligible. Employees and their immediate families, including but not limited to household members (whether related or not), of Sponsor Parties are not eligible. This sweepstakes is subject to all federal, state, and local laws and is void where prohibited. The Sponsor reserves right to verify eligibility qualifications of the winner.
6) DISCLAIMER: If for any reason this sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, printing or typographical errors, or any other causes beyond the control of any of the Sponsor Parties, the Sponsor may at its sole discretion, disqualify any individual who tampers with the entry process, and cancel, terminate, modify or suspend the sweepstakes. In the event this sweepstakes is cancelled, Sponsor will conduct a random drawing to award the prize from among all eligible entries received as of the sweepstakes termination date and time. Sponsor Parties, and respective employees of each, assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, nor are they responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this sweepstakes or downloading any materials in this sweepstakes. CAUTION: ANY ACT OR ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ACT OR ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ACT OR ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of the winner based on an email address, the winning entry will be deemed to be made by the authorized account holder when the entry was submitted of the email address from which the entry was submitted. "Authorized account holder" is defined as the individual who is assigned to an email address by an Internet access provider, on-line service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
7) MEAL ASSEMBLY NETWORK LLC PRIZE WINNER: To receive notification of the winner by mail, send a self-addressed stamped envelope with a formal request in writing to Meal Assembly Network LLC Winner, 8892 Gray Fox Dr, Evergreen, CO 80439. Requests received after August 1, 2009, will not be honored.
8) SPONSOR, PROMOTER, AND ADMINISTRATOR: The Sponsor of this sweepstakes is Meal Assembly Network LLC, 8892 Gray Fox Dr, Evergreen, CO 80439.
9) RELEASE: BY ENTERING THE SWEEPSTAKES OR ACCEPTING ANY PRIZE, THE SELECTED ENTRANT AND THE WINNER AGREE THAT SPONSOR PARTIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY, THE SELECTED ENTRANT AND THE WINNER FOR ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES OR PRIZE RELATED ACTIVITY. WINNER WAIVES ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
10) CHOICE OF LAW AND JURISDICTION: Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants or the winner, Sponsor, and administrator in connection with this sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Colorado or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the State of Colorado. Any action seeking legal or equitable relief arising out of or relating to the sweepstakes or these Official Rules shall be brought only in the courts of the State of Colorado or the United States District Courts of Colorado.
